Terms of service

Overview

Welcome to My Store! The terms “we”, “us” and “our” refer to My Store. We operate this online store and website, including all related content, features, tools, products and services (together, the “Services”) in order to provide you, the customer, with a curated shopping experience.
Our store is powered by Shopify, which enables us to provide the Services to you.

These Terms of Service, together with any other policies referenced herein (the “Terms”), set out your rights and responsibilities when using our Services.
Please read them carefully, as they include important information about your legal rights under UK law.

By visiting, interacting with, or purchasing from our store, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, you should not use or access our Services.

1. Access and Account

By agreeing to these Terms, you confirm that you are at least 18 years old (or the age of majority in your country of residence), and that you have given consent for any minors using your devices to access the Services.

To use our store or purchase products, you may be asked to provide details such as your name, email address, billing and shipping addresses, and payment information. You confirm that all details you provide are accurate, current and complete, and that you have the right to use the payment method provided.

You are responsible for maintaining the confidentiality of your account and password, and for all activity under your account. You must not share, transfer or sell your account to any other person.

2. Our Products

We make every effort to display accurate descriptions and images of our products. However, colours and appearances may vary slightly depending on your screen or device settings.

We do not guarantee that any product or service will meet your personal expectations. Product descriptions, pricing, and availability are subject to change at any time without notice.
We reserve the right to discontinue products or limit quantities at our discretion.

3. Orders

When you place an order through our website, you are making an offer to purchase goods from us. All orders are subject to acceptance. You will receive an order confirmation email once your order has been accepted and payment has been processed.

We may decline or cancel orders for any reason (for example, if a product is out of stock or there has been an error in pricing). If this happens, we will notify you as soon as possible and refund any payments taken.

Please review your order carefully before submission. Once accepted, cancellation requests may not be possible.
Returns and exchanges are handled in accordance with our Refund Policy and your rights under the Consumer Contracts Regulations 2013.

You confirm that any purchases are for personal use only and not for commercial resale.

4. Prices and Payment

All prices are shown in GBP (£) and include VAT where applicable. Delivery costs and any other applicable charges will be shown separately at checkout.

Prices, promotions and discounts are subject to change at any time without notice. The price charged will be the one displayed at the time you place your order.

You agree to provide complete and accurate billing and payment details. You confirm that:

  • You are authorised to use the payment method provided

  • Payment information is true and complete

  • All charges incurred will be honoured by your payment provider

If your payment fails or is disputed, we may suspend or cancel your order.

5. Shipping and Delivery

Delivery times shown at checkout are estimates only and may vary depending on location and postal conditions.
We are not responsible for delays outside our control (such as courier delays, strikes, or adverse weather).

Risk of loss or damage passes to you once the goods are delivered to your address. Until that time, goods remain our responsibility.

If your order does not arrive within the estimated delivery timeframe, please contact us and we will work with the courier to resolve the issue.

6. Intellectual Property

All content, trademarks, text, graphics, logos, product names, and images on our website are owned by My Store, our affiliates, or licensors, and are protected by UK copyright, trademark and other intellectual property laws.

You may use our Services and materials only for personal, non-commercial purposes. You may not reproduce, distribute, modify, or publicly display any content without our prior written consent.

All rights not expressly granted are reserved by My Store.

7. Optional Tools

From time to time, we may provide access to third-party tools or integrations. We do not monitor, control or endorse these tools. They are provided “as is” and “as available” without any warranties or conditions.

Your use of third-party tools is entirely at your own risk. Please ensure you understand and agree to the third party’s terms before using their services.

8. Third-Party Links

Our website may contain links to third-party websites or services. We are not responsible for the content, accuracy, or practices of these websites.

If you choose to access a third-party site, you do so at your own risk. Any purchases or transactions made through a third-party website are between you and that third party. Please review their policies carefully before engaging in any transaction.

9. Your Rights

As a consumer in the UK, you have legal rights under the Consumer Rights Act 2015 and the Consumer Contracts Regulations 2013. These include the right to receive goods that are as described, of satisfactory quality, and fit for purpose.

If your goods are faulty, you are entitled to a repair, replacement, or refund depending on the circumstances. Nothing in these Terms limits or affects your statutory rights.

10. Relationship with Shopify

My Store is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with My Store. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and My Store, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with My Store.

10. Privacy Policy

All personal information we collect through our Services is handled in accordance with our Privacy Policy, and certain information may also be processed by Shopify in accordance with their Privacy Policy.
By using our Services, you acknowledge that you have read and understood these privacy policies.

Because our Services are hosted by Shopify, they collect and process certain personal information about your access and use of the Services to provide and improve the platform. Your information may be shared with third parties that help us operate our store (for example, payment processors or shipping providers).

We comply with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.
If personal data is transferred outside the UK or European Economic Area, it will be done securely and only where adequate safeguards are in place.

Please review our Privacy Policy for details on how we, Shopify, and our partners collect, use, and protect your personal data.

11. Feedback

If you submit any ideas, suggestions, feedback, reviews, or other content (“Feedback”) to us, you grant us a non-exclusive, worldwide, royalty-free, perpetual licence to use, reproduce, modify, publish, and display such Feedback in any media for business and marketing purposes.

You confirm that:

You must not provide Feedback that is defamatory, obscene, harassing, discriminatory, or otherwise unlawful. You are solely responsible for any Feedback you post and any resulting consequences.

12. Errors, Inaccuracies, and Omissions

Occasionally, information on our website or Services may contain typographical errors or inaccuracies relating to product descriptions, pricing, promotions, or availability.
We reserve the right to correct these errors and to update or cancel orders affected by such inaccuracies without prior notice (including after an order has been placed).
Where an error affects your order, we will contact you to offer the option to reconfirm or cancel.

13. Prohibited Uses

15. Disclaimer of Warranties

We make reasonable efforts to ensure that information on our website is accurate and up to date. However, all content is provided for general information only, and we do not guarantee that the Services will be error-free or uninterrupted.

Except as required by law (including your statutory consumer rights), the Services and all products are provided “as is” and “as available” without warranties of any kind, express or implied.

17. Indemnification

You agree to indemnify and hold harmless My Store, Shopify, and our affiliates, officers, employees, and contractors from any claims, liabilities, damages, or expenses (including reasonable legal fees) arising from your breach of these Terms or misuse of the Services.

We will promptly notify you of any such claim, and you agree to cooperate fully in our defence.

18. Severability

If any provision of these Terms is found to be unlawful or unenforceable, the remaining provisions shall remain valid and enforceable to the fullest extent permitted by law.

19. Waiver and Entire Agreement

Our failure to enforce any part of these Terms shall not be considered a waiver of our rights.
